Albertville, AL – Sand Mountain Skate is excited to announce its relocation from the Sand Mountain Amphitheater to the Downtown Albertville Farmers Market at 314 Sand Mountain Dr. This move marks an exciting new chapter for the city's Christmas season, bringing the popular skating experience into the heart of Albertville’s vibrant downtown district. 

Starting Thursday, November 21st, skaters of all ages can enjoy Sand Mountain Skate at its new location. The charm of downtown Albertville will create a unique, family-friendly experience at the Farmers Market parking area. 

Skate Sizes start at 12J up to an adult size of 13. 

In case of inclement weather, ticket holders can change the pre-purchased session to another date and time. 

Purchasing skate tickets in advance does not guarantee priority for sizing or capacity.

All Skate Aids are on a first-come, first-serve basis.

RELEASE OF LIABILITY, WAIVER OF CLAIMS AND
INDEMNIFICATION AGREEMENT FOR SAND MOUNTAIN PARK & AMPHITHEATER

Notice – By signing this document you may be waiving certain legal rights, including the right to sue. Release and Waiver of Claims; Indemnification Agreement

In consideration of being allowed to use the facilities and participate in programs and events (“Programs”) at Sand Mountain Park (the “Facility”), the Participant, and the Participant’s parent(s) or legal guardian(s) if the Participant is a minor, do hereby agree, to the fullest extent permitted by law, as follows:

PHOTO AND VIDEO RELEASE

1) TO WAIVE ALL CLAIMS that they have or may have against the Facility arising out of the Participant’s participation in the Programs or the use of any equipment provided by the Facility (“Equipment”). The Participant and his/her Parents or legal guardian(s) specifically understand that they are releasing any and all claims that arise or may arise from any negligent acts or conduct of the Facility, its owners, affiliates, operators, employees, agents, and officers, to the fullest extent permitted by law. However, nothing in this Agreement shall be construed as a release for conduct that is found to constitute gross negligence or intentional conduct.

2) TO ASSUME ALL RISKS of participating in the Programs and using the Equipment, even those caused by the negligent acts or conduct of the Facility, its owners, affiliates, operators, employees, agents, and officers. The Participant and his/her Parents or legal guardian(s) understand that there are inherent risks of participating in the Programs and using the Equipment, which may be both foreseen and unforeseen and include serious physical injury and death;

3) TO RELEASE the Facility, its owners, affiliates, operators, employees, agents, and officers from all liability for any loss, damage, injury, death, or expense that the Participant (or his/her next of kin) may suffer, arising out of his/her participation in the Programs and use of the Equipment; and

4) TO INDEMNIFY the Facility, the City of Albertville, Sports Facilities Management, LLC, SMP SFM, LLC and their owners, affiliates, operators, employees, agents, and/or officers, from all liability for any loss, damage, injury, death, or expense that the Participant (or his/her next of kin) may suffer, arising out of participation in Programs and use of the Equipment.

5) I ALSO ACKNOWLEDGE AND FULLY UNDERSTAND THAT I (and/or child) CANNOT PARTICIPATE IN ANY ACTIVITIES IF I (and/or child) HAVE RECENTLY SUFFERED FROM ANY FEVER, SORE THROAT, VOMITING, DIARRHEA, OR ANY OTHER COMMUNICABLE SYMPTOMS OR HAVE BEEN EXPOSED RECENTLY TO SOMEONE WITH THESE SYMPTOMS. I FURTHER ACKNOWLEDGE THAT OTHER PARTICIPANTS IN THESE ACTIVITIES MAY BE INCUBATING DISEASES INCLUDING COVID-19, AND MAY BE CAPABLE OF SPREADING DISEASE TO OTHERS.

The Participant understands that his/her participation in the Programs is voluntary and further understands that he/she has the opportunity to inspect the Facility before any participation.

The Participant understands that he/she is obligated to follow the rules of the Programs and that he/she can minimize his/her risk of injury through the exercise of common sense and by being aware of his/her surroundings.

If, while participating in the Programs, the Participant observes any unusual hazard, which he/she believes jeopardizes his/her personal safety or that of others, he/she will remove himself/herself from participation in the Programs and immediately bring said hazard to the attention of the Facility.

To the extent that any portion of this Agreement is deemed to be invalid under the law of the State of Alabama, the remaining portions of the Agreement shall remain binding and available for use by the Facility and its counsel in any proceeding.

Photo and Video Release - In consideration of the opportunity to provide certain statements and participate in photography or audio/video taping relating to certain products of Sand Mountain Park “Park”, the City of Albertville, Alabama or their affiliated companies and entities, I, for myself and, in the case of a minor (the "Minor"), for myself and the Minor in my capacity as the Minor's parent/guardian, agree as follows:

1) I hereby consent to the recording of statements, photographs, and/or audio or video recordings taken of the Minor or me by the Park or its contractors.

2) All statements, photographs, and/or audio or video recordings taken of the Minor or me, by the Park or its contractors, may be used by the Park for promotional, commercial or other purposes as determined by the Partnership anywhere in the world in its sole discretion. Neither the Minor nor I shall have any right to control the use or publication by the Partnership of the statements, photographs, and/or audio or video recordings.

3) All statements, photographs, and/or audio or video recordings taken of the Minor or me by the Park or its contractors, shall be the sole property of the Park. Neither the Minor nor I shall receive any compensation in connection with use of these statements, photographs, and/or audio or video recordings for promotional, commercial or other purposes.

4) On behalf of the Minor and myself, I hereby release, waive and discharge any claims of any kind or nature arising out of or relating to the use of the statements, photographs, and/or audio or video recordings against the Park or any person or firm authorized by the Park to publish said materials (“Publisher”), Such release, waiver and discharge shall also extend to all affiliated companies, shareholders, directors, officers, employees, agents and assigns of the Park and any Publisher. 5) This Release shall be binding upon the Minor and me, and our respective successors, heirs, assigns, executors, administrators, spouse and next of kin. 6)

I HAVE READ THIS DOCUMENT AND I UNDERSTAND THAT I GIVE UP SUBSTANTIAL RIGHTS ON BEHALF OF THE MINOR AND MYSELF (INCLUDING RIGHTS RELATING TO PUBLICITY AND PRIVACY WITH RESPECT TO THE COMMERCIAL USE OF ANY STATEMENTS, PHOTOGRAPHS, AND/OR AUDIO OR VIDEO RECORDINGS AND I SIGN THIS RELEASE FREELY AND VOLUNTARILY.

I HAVE READ AND UNDERSTAND THIS AGREEMENT AND I AM AWARE THAT BY SIGNING THIS AGREEMENT I MAY BE WAIVING CERTAIN LEGAL RIGHTS, INCLUDING THE RIGHT TO SURE.

The parent or Guardian must sign if the Participant is UNDER 18.

En consideración a que se le permita usar las instalaciones y participar en programas y eventos ("Programas") en el Parque Sand Mountain (la "Instalación"), el Participante y los padres o tutores legales del Participante si el Participante es menor de edad, acuerdan, en la mayor medida permitida por la ley, lo siguiente: 
 
PUBLICACION DE FOTOS Y VIDEOS
 
1.	RENUNCIAR A TODAS LAS RECLAMACIONES que tengan o puedan tener contra la Instalacion que surjan de la participación del Participante en los Programas o del uso de cualquier equipo proporcionado por  la Instalacion ("Equipo"). El Participante y sus Padres o tutor(es) legal(es) entienden específicamente que están renunciando a todas y cada una de las reclamaciones que surjan o puedan surgir de cualquier acto o conducta negligente de la Instalación, sus propietarios, afiliados, operadores, empleados, agentes y funcionarios, en la mayor medida permitida por la ley. Sin embargo, nada de lo dispuesto en este Acuerdo se interpretará como una exención por una conducta que se considere constitutiva de negligencia grave o conducta intencionada.
 
2.	ASUMIR TODOS LOS RIESGOS de participar en los Programas y usar el Equipo, incluso aquellos causados por actos o conductas negligentes de la Instalación, sus propietarios, afiliados, operadores, empleados, agentes y funcionarios. El Participante y sus Padres o tutores legales entienden que existen riesgos inherentes a la participación en los Programas y al uso del Equipo, que pueden ser tanto previstos como imprevistos e incluyen lesiones físicas graves y la muerte;
 
3.	LIBERAR a la instalacion, a sus propietarios, afiliados, operadores, empleados, agentes y funcionarios de toda responsabilidad por cualquier pérdida, daño, lesión, muerte o gasto que el Participante (o sus familiares más cercanos) pueda sufrir, que surja de su participación en los Programas y del uso del Equipo; y
 
4.	INDEMNIZAR a la Instalación, a la Ciudad de Albertville,  Sports Faciliteies Management, LLC, SMP SFM, LLC y a sus propietarios, afiliados, operadores, empleados, agentes y/o funcionarios, de toda responsabilidad por cualquier pérdida, daño, lesión, muerte o gasto que el Participante (o sus familiares más cercanos) puedan sufrir, que surjan de la participación en los Programas y el uso del Equipo.  
 
5.	YO TAMBIÉN RECONOZCO Y ENTIENDO COMPLETAMENTE QUE YO (y/o el niño) NO PUEDO PARTICIPAR EN NINGUNA ACTIVIDAD SI YO (y/o el niño) HE SUFRIDO RECIENTEMENTE FIEBRE, DOLOR DE GARGANTA, VÓMITO, DIARREA O CUALQUIER OTRO SÍNTOMA TRANSMISIBLE O HE ESTADO EXPUESTO RECIENTEMENTE A ALGUIEN CON ESTOS SÍNTOMAS. ADEMÁS, RECONOZCO QUE OTROS PARTICIPANTES EN ESTAS ACTIVIDADES PUEDEN ESTAR INCUBANDO ENFERMEDADES, INCLUYENDO EL COVID-19, Y PUEDEN SER CAPACES DE PROPAGAR LA ENFERMEDAD A OTROS.
 
El Participante entiende que su participación en los Programas es voluntaria y entiende además que tiene la oportunidad de inspeccionar el Establecimiento antes de cualquier participación. 
El Participante entiende que está obligado a seguir las reglas de los Programas y que puede minimizar su riesgo de lesiones mediante el ejercer el sentido común y siendo consciente de su entorno.  
Si, mientras participa en los Programas, el Participante observa algún peligro inusual, que cree que pone en peligro su seguridad personal o la de los demás, se retirará de la participación en los Programas y pondrá inmediatamente dicho peligro en conocimiento del Centro.  
En la medida en que cualquier parte de este Acuerdo se considere inválida según la ley del Estado de Alabama, las partes restantes del Acuerdo seguirán siendo vinculantes y estarán disponibles para su uso por parte del  la Instalacion y su abogado en cualquier procedimiento.  
Autorización de publicacion de fotos y videos: En consideración a la oportunidad de proporcionar ciertas declaraciones y participar en fotografías o grabaciones de audio / video relacionadas con ciertos productos de Sand Mountain Park "Park", la Ciudad de Albertville, Alabama o sus compañías y entidades afiliadas, yo, por mí mismo y, en el caso de un menor (el "Menor"), por mí y por el Menor en mi calidad de padre/tutor del Menor,  acuerdan lo siguiente:  
1.	Yo doy mi consentimiento para la grabación de declaraciones, fotografías y/o grabaciones de audio o video tomadas del Menor o mías por el Parque o sus contratistas.
 
2.	Todas las declaraciones, fotografías y/o grabaciones de audio o video tomadas del Menor o mías, por el Parque o sus contratistas, pueden ser utilizadas por el Parque para fines promocionales, comerciales o de otro tipo, según lo determine la Asociación en cualquier parte del mundo a su entera discreción. Ni el Menor ni yo tendremos derecho a controlar el uso o la publicación por parte de la Sociedad de las declaraciones, fotografías y/o grabaciones de audio o video. 
 
3.	Todas las declaraciones, fotografías y/o grabaciones de audio o video tomadas del Menor o de mí por el Parque o sus contratistas, serán propiedad exclusiva del Parque. Ni el Menor ni yo recibiremos ninguna compensación en relación con el uso de estas declaraciones, fotografías y/o grabaciones de audio o video con fines promocionales, comerciales o de otro tipo.  
4.	En nombre del Menor y en el mío propio, por la presente libero, renuncio y descargo de cualquier reclamo de cualquier tipo o naturaleza que surja de o esté relacionado con el uso de las declaraciones, fotografías y/o grabaciones de audio o video contra el Parque o cualquier persona o empresa autorizada por el Parque para publicar dichos materiales ("Editor"),  Dicha liberación, renuncia y descargo también se extenderá a todas las compañías afiliadas, accionistas, directores, funcionarios, empleados, agentes y cesionarios del Parque y cualquier Editor
 
5.	Esta Liberacion será vinculante para el Menor y para mí, y para nuestros respectivos sucesores, herederos, cesionarios, albaceas, administradores, cónyuge y parientes más cercanos.
 
6.	HE LEÍDO ESTE DOCUMENTO Y ENTIENDO QUE RENUNCIO A DERECHOS SUSTANCIALES EN NOMBRE DEL MENOR Y EN EL MÍO (INCLUIDOS LOS DERECHOS RELACIONADOS CON LA PUBLICIDAD Y LA PRIVACIDAD CON RESPECTO AL USO COMERCIAL DE CUALQUIER DECLARACIÓN, FOTOGRAFÍA Y/O GRABACIÓN DE AUDIO O VIDEO) Y FIRMO ESTA AUTORIZACIÓN LIBRE Y VOLUNTARIAMENTE.
 
HE LEÍDO Y ENTIENDO ESTE ACUERDO Y SOY CONSCIENTE DE QUE AL FIRMAR ESTE ACUERDO PUEDO ESTAR RENUNCIANDO A CIERTOS DERECHOS LEGALES, INCLUIDO EL DERECHO A DEMANDAR.
